Terms of Service
The rules for using PreTraffic, what an AI-generated audit is (and isn't), account terms, acceptable use and limitation of liability.
1. Who we are
PreTraffic is operated by AI Quantum Ventures LLC ("PreTraffic", "we", "us"), based in the United States. These Terms of Service ("Terms") govern your access to and use of the PreTraffic website, dashboard, subscriber portal, Shopify application and audit reports (together, the "Service"). By creating an account, submitting a store URL, or purchasing an audit or subscription, you agree to these Terms. If you do not agree, do not use the Service.
2. What the Service does
PreTraffic runs simulated shopper panels against a storefront URL you submit. AI agents load your pages, browse them the way a prospective buyer would, and produce a report containing verdicts, drop-off moments, findings, a scorecard and prioritised recommendations. Free runs cover a limited panel and a single page; paid runs cover a larger panel and a longer journey through your store.
3. AI-generated directional insight — no guaranteed outcome
This is important, so we state it plainly. Every PreTraffic report is generated by automated systems and large language models. Reports are directional insight, not fact, not professional advice, and not a prediction you should treat as certain. Specifically:
- Simulated shoppers are models of buyer behaviour. They are not real customers and their reactions are not measurements of real customer behaviour.
- Predicted conversion ranges, grades, scores and revenue-impact estimates are modelled estimates. They are not forecasts, warranties, or promises of results.
- AI systems can misread a page, miss content, or produce inaccurate statements. You are responsible for reviewing any finding before acting on it.
- We do not guarantee any increase in conversion rate, revenue, traffic quality, ad performance or any other business outcome from using the Service or implementing its recommendations.
PreTraffic is a decision-support tool. Business decisions you make on the basis of a report remain your decisions.
4. Accounts and access
Some parts of the Service require an account or a magic-link session sent to your email address. You are responsible for keeping access to that email address secure, and for all activity that occurs under your account or magic-link session. Report links are unguessable URLs; anyone who has the link can view the report, so treat it as confidential if it contains sensitive information. Tell us promptly at support@pretraffic.ai if you believe your account or a report link has been compromised.
You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a company, you confirm that you are authorised to bind that company to these Terms.
5. Store URLs you submit
By submitting a URL, you confirm that you own the store or are authorised to have it audited. You must not submit URLs for sites you do not control, sites behind a login you are not permitted to share, or sites where automated access would breach a third party's rights or terms. We may refuse or cancel any run at our discretion, including where a store blocks automated access or where we believe a submission breaches this section.
6. Acceptable use
You agree not to:
- use the Service to attack, load-test, scrape at scale, or otherwise disrupt any website, including your own;
- resell, sublicense, or white-label PreTraffic reports as your own product without a written agency agreement with us;
- reverse engineer, decompile, or attempt to extract the prompts, models, or engine logic behind the Service;
- circumvent usage limits, free-tier gating, billing, or rate limits, including via automated account creation;
- upload or submit unlawful, infringing, or malicious content;
- use the Service to build a competing product or to train a competing model.
We may suspend or terminate access immediately for a breach of this section.
7. Plans, billing and taxes
Paid audits are sold as a $99 one-time purchase per full-panel run. Continuous monitoring is sold as a $149/month subscription that renews automatically until cancelled. Prices are in US dollars and exclusive of any applicable VAT or sales tax, which is added at checkout where required. Payments are processed by Stripe; Shopify-installed merchants may instead be billed through Shopify Billing. Refunds and cancellation are governed by our Refund & Cancellation Policy, which forms part of these Terms.
8. Your content and our content
You keep all rights in your store, your brand, and any content we capture from your pages. You grant us a limited licence to access, render, screenshot, store and process that content solely to run audits, deliver reports, provide support, and improve the reliability of the Service. We do not sell your content, and we do not use your store content to train third-party foundation models.
We keep all rights in the Service, the engine, the report format, the scorecard methodology, and all software and documentation. You may use and share the reports we deliver to you for your own business purposes.
9. Third-party services
The Service depends on third parties including Stripe (payments), Resend (email delivery), Supabase (database, storage and authentication), Shopify (for the embedded app) and model/inference providers used by our audit engine. We are not responsible for outages or acts of those providers, though we will act reasonably to route around them. See our Privacy Policy for how data flows to them.
10. Availability
We aim for high availability but do not promise uninterrupted service. We may change, suspend, or discontinue features. If we discontinue a paid feature that is material to your subscription, you may cancel and we will refund the unused portion of the current period.
11. Disclaimer of warranties
To the maximum extent permitted by law, the Service and all reports are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy or completeness of any output. Nothing in these Terms excludes rights you have as a consumer under mandatory law, including under German and EU consumer law.
12. Limitation of liability
To the maximum extent permitted by law:
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost sales, lost data, or business interruption, even if advised of the possibility;
- we are not liable for decisions you make, ad spend you commit, or changes you ship on the basis of a report;
- our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 100.
Nothing here limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot be limited under applicable law.
13. Indemnity
You will indemnify and hold us harmless from third-party claims arising out of your breach of these Terms, your misuse of the Service, or your submission of a URL you were not authorised to have audited.
14. Term and termination
These Terms apply for as long as you use the Service. You may stop using it at any time and cancel any subscription as described in the Refund & Cancellation Policy. We may suspend or terminate access for breach, suspected fraud, chargeback abuse, or where required by law. Sections that by their nature should survive termination (ownership, disclaimers, liability, indemnity, governing law) survive.
15. Changes to these Terms
We may update these Terms. When we make a material change we will update the effective date at the top of this page and, for active subscribers, notify you by email before the change takes effect. Continued use after the effective date means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware and the federal laws of the United States, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The state and federal courts located in Delaware have exclusive jurisdiction, except that consumers may also bring proceedings in the courts of their place of residence where mandatory law allows.
